jocoly.com is a personal portfolio site run by Joseph Lyell ("I", "me"). It hosts a few small games and projects, including Lo-Fly and the Daily Game. By using the site you agree to these terms. If you don't agree, please don't use it.
Using the site
The site and games are free to use for personal, non-commercial play and browsing. Please don't attack the site, scrape it aggressively, interfere with other people's use of it, or try to get around its technical limits. The games are works in progress and change often. Features, progress and saved settings can break or disappear without notice.
Tip Jar, and no refunds
Nothing on jocoly.com is for sale. The "Tip Jar" link goes to Ko-fi, a separate service, where you can choose to send a voluntary tip. Tips are gifts. They don't buy a product, a service, an account, an upgrade or any other benefit, and you aren't promised anything in return.
Because tips are voluntary gifts and nothing is purchased, there is no refund policy and tips are non-refundable. Payments are handled entirely by Ko-fi and its payment providers under their own terms and privacy policy, and I don't see or store your payment details. If a tip was sent by mistake or you have a payment problem, contact Ko-fi support first.
Ownership
The site's code, art and games are mine unless noted otherwise. Third-party assets, such as the NASA imagery and 3D models and the rubber duck model, belong to their creators and are used under their own licenses. Credits are in SITE-CREDITS.txt and in each game's credits file. Please don't copy or redistribute my work as your own. Linking to the site is always welcome.
No warranty
The site and games are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, availability, accuracy, or being free of errors or bugs. Some games use fast motion, flashing effects and sound, so use your own judgment, and stop if you feel unwell.
Limit of liability
To the fullest extent permitted by law, I'm not liable for any indirect, incidental, special or consequential damages, or any loss of data, progress or profits, arising from your use of, or inability to use, the site or games. Nothing in these terms limits any right or liability that can't legally be limited.
Links to other sites
The site links to other services, such as Ko-fi. I don't control them and I'm not responsible for their content or practices.
Privacy
How the site handles data is described in the Privacy Policy.
Governing law
These terms are governed by the laws of the State of Indiana, USA, without regard to conflict-of-law rules.
Changes
I may update these terms from time to time. The date above shows the latest version, and continuing to use the site after a change means you accept it.
